Terms and Conditions
1. Scope
These Terms and Conditions apply to all contracts between you and the provider for the use of Vayvolt products and services (e.g. Forge licences, subscriptions), unless expressly agreed otherwise.
The use of Vayvolt Forge is intended exclusively for business purposes. Use by consumers within the meaning of Section 13 of the German Civil Code (BGB) is excluded. For the purchase of Vayvolt indie games (e.g. via external platforms such as Steam), consumer rights – in particular the right of withdrawal – apply in accordance with the respective platform operators' terms.

3. Conclusion of contract
The presentation of our offers on the website does not constitute a legally binding offer but an invitation to submit an offer. By submitting the order form (e.g. Forge checkout) you make a binding offer. The contract is formed when we accept your order by confirmation or by providing the service (e.g. licence key, access).
4. Services
The specific service (e.g. Forge Mini, Starter or Pro as licence or subscription) is determined by the product description and your selection at the time of purchase. Licences and subscriptions are provided after payment has been received or after confirmation (for free offers). Where offered, a free trial period (e.g. 14 days) may be used; details and cancellation before the trial ends are shown at checkout.
5. Prices and payment
The prices displayed at the time of order apply, in Euro. Payment is made via Stripe (card and other methods offered by Stripe). Stripe's terms also apply to payment processing. For subscriptions, the agreed fee is due at each billing period; during a trial, the first charge occurs after the trial ends unless you cancel earlier. VAT is not charged pursuant to § 19 of the German VAT Act (small business scheme).
6. Term and termination
Subscriptions are subject to the terms displayed at the time of purchase (e.g. monthly). The subscription may be cancelled at the end of the billing period. Cancellation can be made via the customer portal (manage subscription) or by email to us. One-time licences apply indefinitely for the purchased version unless otherwise stated.
7. Right of withdrawal
Consumers have the statutory right of withdrawal. Information on withdrawal and its exercise can be found in the confirmation email or on the website. For digital content not supplied on a physical medium, the right of withdrawal may lapse once we have begun performance with your consent.
This right of withdrawal applies in particular to contracts for Vayvolt indie games where you act as a consumer. For contracts concerning Vayvolt Forge, which are aimed exclusively at business customers (entrepreneurs within the meaning of Section 14 BGB), no statutory right of withdrawal applies.
8. Liability
We are fully liable for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only in case of breach of essential contractual obligations and only for foreseeable, typically occurring damage. Liability for lost profit and indirect damage is excluded to the extent permitted by law.
9. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for disputes is, to the extent permitted by law, the seat of the provider. If individual provisions are invalid, the validity of the remaining provisions is unaffected.
Changes to these Terms will be published on this page. For existing contracts, the version valid at the time of conclusion applies unless otherwise agreed.
